Prior to this, Schmidt ran for Governor of Kansas in 2022, served three terms as Kansas Attorney General and as Senate Majority Leader in the Kansas Legislature. The 2nd District encompasses part of Wyandotte County, Topeka, Emporia, Junction City and Leavenworth.

Schmidt is up for re-election in 2027.

Separation of Church and State
  • Schmidt sat on a KBI report that showed more than 400 children in Kansas were sexually abused by Catholic clergy members.

  • Schmidt opposed COVID restrictions for religious gatherings and urged police not to enforce them, when issued by Governor Kelly.

  • Schmidt appears to be religious, according to his Facebook where he makes several references to the Bible.

LGBTQ+ Equality
  • Schmidt defended Kansas in a lawsuit brought by the ACLU, which sought to invalidate Kansas’s ban on same-sex marriage and its prohibition of allowing same-sex couples to change the names on state drivers' licenses to reflect their married names, receive spousal health benefits, or file joint state tax returns.

  • Schmidt filed and obtained a petition in the Kansas Supreme Court to halt the issuance of licenses to same-sex couples after the chief district judge of Johnson County ordered the state to issue licenses to same-sex couples.

  • Schmidt petitioned the U.S. Supreme Court to block an order from a federal district judge who struck down Schmidt’s initial injunction, but they denied his request.

  • Schmidt said he would sign Senate Bill 160 if elected governor which would have mandated athletic teams sponsored by public schools and colleges in Kansas align participation in a sport with an individual’s gender assigned at birth.
Education
  • Schmidt helped pass a bill which failed to adequately fund public schools, according to the Kansas Supreme Court.

  • Schmidt requested and obtained a stay to keep Governor Sam Brownback’s block-grant law for financing the state’s 285 school districts after a three-judge panel in Shawnee County found it unconstitutional.

  • Schmidt argued schools shouldn’t be shut down after Governor Sam Brownback signed a law that he claimed rectified inequities in Kansas’s funding for schools.

  • Schmidt proposed deploying armed law enforcement officers to schools after the murder of 21 people in a Texas school’s fourth-grade classroom.

  • Schmidt says he wants to give parents more say over classroom curriculum, like stopping gender and sexual identity content for young children.

Reproductive Rights
  • Schmidt said he planned to defend abortion restrictions that are currently in place, arguing they are in jeopardy of being struck down by state courts after the 2022 abortion vote.

  • Schmidt supported the 2022 Value Them Both Constitutional Amendment to give the legislature authority to ban abortion without exceptions.

  • Schmidt said the overturning of Roe v. Wade was the “right” decision.

  • Schmidt said ending an ectopic pregnancy doesn’t constitute abortion but still supports a statewide ban on abortion.

  • Schmidt urged the Kansas Supreme Court to reconsider its decision that a law prohibiting an abortion procedure violates the state constitution.

  • Schmidt asked the U.S. Supreme Court to reverse an appeals court decision that ruled in favor of Planned Parenthood and against Kansas government officials who terminated Medicaid contracts with Planned Parenthood.
Health Care

  • Schmidt opposes Medicaid expansion but wants to improve the current health care system by offering more medical student loan repayments to doctors and medical specialists who work in underserved rural areas.
  • Schmidt sued to overturn the Affordable Care Act alongside 18 Republican attorneys general including Missouri Attorney General Eric Schmitt in 2021.

  • Schmidt sued to overturn the Affordable Care Act alongside 19 Republican attorneys general in 2018.

  • Schmidt challenged vaccine mandates implemented by the Biden administration requiring workers for larger employers to either be vaccinated or submit to regular testing.

  • Schmidt promised to oppose vaccine mandates for Kansas kids who would have to be immunized for COVID-19 before attending school.

Economic Security

  • Schmidt pledged to oppose income tax hikes in his congressional race in a pledge to Americans for Tax Reform.

  • Schmidt wanted to enact a tax plan that exempted pensions, Social Security. and private retirement distributions from state income tax, and removed sales tax for necessities like diapers and feminine hygiene products.

  • Schmidt refused to say if he would veto Sam Brownback’s failed tax experiment during a 2022 debate with Governor Laura Kelly.

  • Schmidt proposed an amendment to prevent transportation funding from being raided for anything but its intended purposes.

Immigration

  • Schmidt cosponsored the Laken Riley Act which requires undocumented immigrants who are arrested for theft or violent crimes to be held in jail pending trial.

  • Schmidt said he wanted to emulate Ron DeSantis’s immigration policy if elected governor. This was shortly after DeSantis sent Venezuelan migrants on a plane to Martha’s Vineyard under false pretenses.

  • Schmidt believes sanctuary jurisdictions have no authority to block the federal government from enforcing immigration law and deporting undocumented individuals.

  • Schmidt filed bills in 2022 to create a state law blocking local municipal governments from adopting rules against cooperation with federal law enforcement investigating illegal immigrants.

  • Schmidt: “We must enforce the Trump border policies.”

  • Schmidt was endorsed by the National Border Patrol Council which represents agents who work at the southern border of the United States.

“As I said in announcing my candidacy, what is best for our district and for America will always be my steady guidepost. I will start immediately to prepare so that on day one – January 3, 2025 – we can get straight to work securing our border, reducing the high cost of living, reducing the regulatory burden, and addressing the many other priorities Kansans have told me are important for our great country.”
